CONDITIONS OF SALE

1/ General

Orders are accepted by Falcon Aviation subject to the following terms and conditions. These conditions override and supersede any previous terms published or negotiated by Falcon Aviation and its customers. All descriptions and illustrations detailed on the Falcon Aviation website and catalogue or communicated the customers are merely intended to present a general idea of our products and nothing contained in any of them shall form part of a contract between Falcon Aviation and the customer

2/ Prices

All prices quoted, exclude postage and packing VAT is not charged. Postal charges will be held at the appropriate rate. Whilst every effort is made to maintain the prices.

3/ Ordering

To assist prompt despatch full description and reference number (where shown) shall be provided by the customer.

Falcon Aviation will not substitute one product for another, unless so authorised by the customer. We give notice, that due to production requirements, it may be necessary to vary specifications without notice.

4/ Despatch

It is our policy to despatch all items by the fastest means possible at most economical rates. As a general rule, products will be despatched by Royal Mail, first class post.

Should other specific methods be required by the customer we will employ these at the appropriate cost to the customer. Falcon Aviation will not compensate for damages or other liability resulting from non or late delivery of products Also, for whatever reason consequential loss or otherwise resulting from this.

The customer, shall indicate in writing, any non delivery, within a period of 5 working days from invoice date. Damages and shortages must be formally communicated to Falcon Aviation within 3 working days from receipt of goods. Parcels in a damaged condition must be refused. Falcon Aviation cannot accept any responsibility unless the above conditions are met.

5/ Warranty

Falcon Aviation warrants that it will, at its option replace, or refund at the purchase price, any product supplied by Falcon Aviation which under normal useage, defects appear. This will be subject to a claim in writing within 6 months from date of invoice. (or any such period indicated by Falcon Aviation)

There shall be no condition or warranty expressed or implied binding Falcon Aviation as to the quality of the goods supplied, nor shall they will be suitable for any particular purpose or for use under any specific conditions.

Under no circumstances what so ever will any liability be accepted for damages or consequential loss arising in connection with any goods or material of any description supplied by Falcon Aviation.

6/ Passing of Property and

The risk of loss or damage to the product shall pass to the customer at time of delivery. Title of property, shall not pass to the customer until all sums owing have been paid to Falcon Aviation.

7/ Product and Availability Information

Specifications are provided on the basis of good faith, and therefore does not constitute a guarantee. Falcon Aviation recommends that the customer verifies such dimensions and other data published in our catalogue and website.

The customer shall be responsible for ensuring the fitness of the product for the customers application. Falcon Aviation reserves the right, without prior notice, to discontinue any product or to apply design changes or offer specifications as part of its continuous programme of product improvement.

8/ Payment

Payment may be made by Credit Card., Cheques or Postal Orders, made payable to ’Falcon Aviation’ and crossed ‘A/C Payable’.

9/ Returns of Goods

Goods can only be returned to Falcon Aviation with prior consent. Goods specially produced for customers may not be returned to Falcon Aviation for credit action.

10/ Order Cancellation

Cancellations or part cancellations of any order can only be accepted after prior negotiation and which shall indemnify Falcon Aviation against any expenses incurred.

11/ Copyrights and Patents

Products sold by Falcon Aviation via its Website and Catalogue are subject to Patents and Trademarks. The Website and Catalogue are subject to Falcon Aviation copyright and may not be reproduced in part or whole, without the written permission of Falcon Aviation. It is acknowledged that the trade marks and trade names on the current Falcon Aviation Web Site, are property of their respective companies/owners.

12/ Specific Conditions of Sale

Falcon Aviation reserves the right to decline to trade with any company or person.
